The rules that govern your use of Muses Exchange. Plain-English, binding, and written to reflect what the platform actually is today: a paper-trading simulation.
These Terms of Use (the "Terms") form a binding agreement between you ("you", "your") and Muses Exchange (referred to as "Muses", "we", "us", "our" or "the operator"), the operator of the website and paper-trading platform at muses.exchange (together, the "Service"). By creating an account, joining the waitlist, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.
The Service is a paper-trading simulation. It allows you to trade a curated roster of music artists using virtual credits against prices that are derived from public streaming and performance data. The Service does not accept, hold, transfer, or pay out real money. The Service is not a broker-dealer, exchange, investment firm, alternative trading system, crypto asset service provider, or any other regulated financial-services provider, and it does not offer securities, derivatives, commodities, crypto-assets, or any other financial instrument within the meaning of the EU Markets in Financial Instruments Directive (MiFID II), the EU Markets in Crypto-Assets Regulation (MiCA), or any equivalent national framework.
You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. You represent and warrant that you meet these requirements each time you access the Service.
You may not use the Service if you are prohibited from doing so under the laws of your country of residence or any country from which you access the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering, notify us promptly if you suspect any unauthorised use of your account, and use only one account per person unless we agree otherwise in writing.
Your paper-trading portfolio, virtual balance, order history, and other account data are stored on our servers so you can access them across devices. They may be reset, migrated, or cleared from time to time as the Service evolves; we will endeavour to give reasonable notice where this affects you materially.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for your personal, non-commercial enjoyment.
You agree not to, and not to attempt to:
robots.txt.The Service, including its source code, user interface, design, branding, and written content, is owned by Muses or our licensors and is protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms transfers any ownership right to you. Artist names, likenesses, and catalogue metadata referenced on the Service are the property of their respective owners and are used for identification and commentary; their inclusion does not imply endorsement or affiliation.
If the Service allows you to post public content — such as a display name, profile description, or entries on a leaderboard — you retain ownership of that content and grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, and display it solely for the purpose of operating and promoting the Service. You represent that you have the right to grant this licence. We may remove content that breaches these Terms or applicable law without prior notice.
Our handling of personal data is described in the privacy policy, which forms part of these Terms. Our use of cookies and similar technologies is described in the cookies policy.
Nothing on the Service constitutes financial, investment, legal, or tax advice. Prices, rankings, charts, news summaries, research, leaderboards, and any signals produced by the Service are provided for entertainment and educational purposes only, are not personalised to your circumstances, and must not be relied upon as the basis for any real-world financial decision. If you need advice, consult a professional appropriately licensed in your jurisdiction. The Service's risk notice describes, for context, the risks that would apply if Muses ever moves beyond paper-trading.
The Service is provided on a best-efforts basis. We do not guarantee uninterrupted availability, the continued availability of any particular artist, the accuracy of any price, or the persistence of any virtual position. Upstream data feeds may be delayed, inaccurate, or unavailable. We may modify, suspend, or discontinue any part of the Service at any time.
You may stop using the Service at any time and may delete your account from the in-app account settings or by emailing us. We may suspend or terminate your access immediately, with or without notice, if we believe you have breached these Terms, created a risk or legal exposure for Muses or other users, or engaged in conduct that is manifestly abusive. On termination, the licences granted to you under these Terms end, but any section intended by its nature to survive — including the sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survives.
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that prices, analytics, or any other information on the Service are accurate, complete, or timely, and we expressly disclaim any such warranty.
To the maximum extent permitted by applicable law, in no event will Muses, its affiliates, contractors, or licensors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or other intangible losses, arising out of or in connection with your use of the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and regardless of whether we have been advised of the possibility of such damages. Because the Service is provided free of charge and involves no real-money exposure, our aggregate liability for any claim arising out of or in connection with the Service is limited to one hundred euros (€100) or the minimum amount that cannot be lawfully excluded, whichever is greater. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or wilful misconduct.
You agree to indemnify and hold harmless Muses, its affiliates, and their respective directors, officers, employees, and agents from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of or relating to your breach of these Terms, your misuse of the Service, or your violation of any right of a third party.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, take reasonable steps to notify registered users in advance — typically by email to the address on file, by in-app banner, or both. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. The courts of Amsterdam, the Netherlands, have exclusive jurisdiction to hear any such dispute, save that, where you are a consumer ordinarily resident in the European Union or the United Kingdom, nothing in this clause affects your right to bring proceedings in the courts of your country of residence or to rely on mandatory consumer-protection provisions of your local law.
